A loaded semi-truck can weigh 80,000 pounds, and when it hits a car or a motorcycle, the injuries are often severe or fatal. Trucking companies and their insurers move fast after a crash to protect themselves. We move fast to protect you.

From our Greeley office we handle truck crashes on I-25, I-76, US 34, US 85 and county roads around Greeley, and throughout Colorado.

Why truck cases are different

  • The other side is already working. Many trucking companies send investigators and lawyers to the scene within hours.
  • Federal rules apply. A driver may drive no more than 11 hours after 10 hours off duty, and carriers must keep driver qualification files and test drivers after serious crashes.
  • The evidence can disappear. Carriers must keep drivers' hours-of-service records for only six months, so we send a written demand to preserve logs, electronic data and dash camera video right away.
  • More than one party can be responsible: the driver, the carrier, the company that loaded the cargo, or the one that maintained the truck.
  • There is usually more insurance. Interstate carriers of general freight must carry at least $750,000 in liability coverage, far more than an ordinary driver.

What it costs

The consultation is free, and we take these cases on a contingency fee: a percentage of what we recover, agreed in writing before we start, with no hourly bill. If there is no recovery you owe no attorney fee; a client may still be responsible for case costs, and for the other side's attorney fees if a court orders them.

Our firm has resolved one truck accident case for more than $2,500,000 and another for more than $4,900,000 (see our representative cases). Every case turns on its own facts; a past result does not predict or promise the outcome of any other matter.

What to do after a truck crash

  1. Get medical care, and keep every record.
  2. Call the police, and write down the truck’s company name, the DOT number on its door, and the trailer number.
  3. Take photos of the truck, your vehicle, the scene and your injuries.
  4. Do not talk to the trucking company’s insurer or sign anything they send.
  5. Call us quickly. The sooner we send a preservation letter, the more evidence survives.

Truck accident questions

How long do I have to file a claim?

For most injuries from a crash, three years from the date of the accident (C.R.S. 13-80-101(1)(n)); a claim for a death has two years (C.R.S. 13-80-102(1)(d)). If a city, county or state vehicle was involved, written notice is due within 182 days (C.R.S. 24-10-109). Evidence fades long before those deadlines, so call early.

Who can be held responsible?

The driver and the trucking company, and sometimes the shipper that loaded the trailer, a maintenance company, or the maker of a failed part. We look at every one, because each may carry its own insurance.

What if the crash was partly my fault?

You can still recover as long as your share of the fault is less than the other side’s, but your damages are reduced by your percentage; at 50 percent or more, you recover nothing (C.R.S. 13-21-111).
