Lawyers For Wrongfully Denied Insurance Claims
You paid your premiums. When your insurer delays, underpays or denies a claim it should cover, we know the games insurance companies play, how to read the policy language, and how to make them pay.
We handle insurance disputes through negotiation, mediation, arbitration and lawsuits, from our Greeley office and across Colorado.
Insurance disputes we handle
- Bad faith: unreasonable delay or denial of a claim
- Coverage disputes over what a policy covers
- Uninsured (UM) and underinsured (UIM) motorist claims
- Property and casualty claims, including home, farm and business losses
- Motor vehicle accidents, personal injuries and wrongful death claims
When an insurer acts in bad faith
Colorado law forbids an insurer from unreasonably delaying or denying payment of a covered benefit. If it does, you can recover two times the covered benefit, plus your attorney fees and court costs (C.R.S. 10-3-1115 and 10-3-1116). Signs your claim is being handled unfairly:
- Months pass with no decision, or repeated requests for the same documents
- An offer far below your documented loss, with no explanation
- A denial that does not point to the policy language it relies on
- Pressure to settle quickly or to give a recorded statement
What to gather
Your full policy, including the declarations page; every letter and email from the insurer; your claim number and notes of each call; and photos, estimates and receipts for the loss.
Insurance questions
What is underinsured motorist coverage?
It pays when the driver who hurt you does not have enough insurance. In Colorado it is added on top of the other driver’s coverage, and it is on your policy unless you turned it down in writing (C.R.S. 10-4-609).
Can I sue my own insurance company?
Yes. If your insurer unreasonably delays or denies a covered claim, you can sue it, and Colorado law allows twice the covered benefit plus attorney fees.
